These Terms of Service govern your use of the PrimeDigitalCraft website and any professional services we provide. By engaging our services or using our website, you agree to the terms set out below.
Scope of Services
PrimeDigitalCraft provides digital agency services including but not limited to digital transformation consulting, web platform design and development, marketing funnel engineering, brand identity design, analytics setup, SEO, automation, e-commerce development, and ongoing maintenance. The specific scope of each engagement is defined in a mutually agreed Statement of Work (SOW) or proposal.
Client Responsibilities
Clients are responsible for providing accurate information, timely feedback, access to necessary systems and accounts, and payment according to the agreed schedule. Delays in providing materials or approvals may impact project timelines.
Intellectual Property
Upon full payment of all agreed fees, PrimeDigitalCraft assigns all rights, title, and interest in the custom deliverables (source code, design files, content) specific to the engagement to the client. PrimeDigitalCraft retains rights to pre-existing tools, frameworks, libraries, and methodologies used in delivery. Third-party components remain subject to their respective licenses.
Payment Terms
Fees, payment schedules, and milestones are specified in the SOW. Unless otherwise stated, a non-refundable deposit may be required to commence work. Final payment is due upon delivery of agreed milestones. Late payments may incur interest at the maximum rate permitted by law.
Warranties & Limitation of Liability
Deliverables will be performed with professional skill and care consistent with industry standards. Except as expressly stated in an SOW, services and the website are provided on an "as is" basis without other warranties. To the maximum extent permitted by law, PrimeDigitalCraft's total liability arising from any engagement shall not exceed the total fees paid for the specific services giving rise to the claim.
Termination
Either party may terminate an engagement as specified in the SOW. Upon termination, client shall pay for all work completed and non-cancellable commitments incurred up to the effective date of termination.
Governing Law
These Terms are governed by the laws of France. Disputes shall first be addressed in good faith; failing resolution, exclusive jurisdiction lies with the competent courts of Thiais, France, without prejudice to mandatory consumer protections.
